ARTICLE 1- INTRODUCTION
These terms and conditions apply to the sale on the https://www.circus-poker.com website of online tickets for participation in poker tournaments organized by the Société Anonyme Gambling Management , whose registered office is located at Rue des Guillemins 129, 4000 Liège, Belgium and registered under number 0859.984.677 (hereinafter the or the "Organizer") at its operating facility located at Av. Baron de Moreau 1, 5000 Namur, Belgium (hereinafter the "Event").
These terms and conditions apply to the sale of tickets by the Organizer.
The Organizer intervenes at the stage of online management of ticket reservations to participate in the Event and is the organizer of the Event.
ARTICLE 2 - PURPOSE
Gambling Management SA sells tickets exclusively in its own name and on its own behalf for the Event for which you purchase a ticket. The ticket remains the property of the Organizer and may be canceled at any time upon reimbursement of the purchase price indicated.
Participation in the Events is authorized for private purposes only; any participation in the context of a professional activity is forbidden, except with the prior agreement of the Organizer. Any use of tickets in connection with any advertising or promotional activity is expressly prohibited, including in connection with any offer of competitions or prize draws, unless express written permission is given by the Organizer.
ARTICLE 3 - PURCHASE AND CONDITIONS OF PARTICIPATION
Tickets can only be purchased by people over 21 with a valid debit card.
All purchases are subject to debit card verification and other security checks so that the transaction may be canceled if the verification process fails.
All credit and debit card transactions are debited at the time of purchase. In the case of credit card purchases, the amount will be debited immediately at the time of the transaction.
At the time of purchase, the purchaser must indicate the persons who will participate in the Event. Tickets are nominative and each participant must be in possession of their ticket.
In order to be authorized to take part in the Event, the participant(s) guarantee(s) to meet all of the following conditions:
- Be at least 21 years old on the day of the Event;
- Be in possession of a valid identity document;
- Not be prohibited from playing by the Gaming Commission or the Organizer or because of his profession;
- Respect the Organizer's house rules;
- Respect the rules applicable to the Event.
The Organizer will verify the conditions of registration at the time of the registration of the participants within the Establishment. The Organizer reserves the right to refuse the registration of any participant who does not meet the conditions of access to the Establishment or who does not meet the conditions of participation in the Event. In this case, the purchaser will be reimbursed for his or her order.
ARTICLE 4 - PRICES
Ticket prices include the currency according to current regulations. Unless otherwise stated, prices are in euros and include all taxes. We inform you that in the event of an incorrect price being displayed, for whatever reason (computer bug, human error, technical error, etc.), the order - even if confirmed - will be canceled. We will inform you as soon as possible. You will then be able, if you wish and subject to availability, to place your order again at the corrected price.
ARTICLE 5 - AVAILABILITY
The Organizer takes great care to ensure the quality of the content posted on the site. The Organizer makes every effort to provide correct and up-to-date information and to correct any errors as quickly as possible, as soon as such errors are brought to its attention.
The Organizer does not guarantee that the Site will remain accessible and free of inaccuracies at all times and under all circumstances. The Organizer cannot therefore be held responsible for any damage or inconvenience that the user may suffer as a result of erroneous, inaccurate or missing information, or as a result of a lack of clarity in the information provided on the Site, nor for information provided by third parties about the said services, for example on a third-party website that refers to them.
The site informs you of product availability in real time when you place your order. If certain tickets are no longer available between the beginning and end of your order, the system will inform you. You can check the contents of your order before validation and payment.
ARTICLE 6 - PAYMENT
All orders are firm and definitive once validated, without prejudice to article 9 paragraph 3. Validation of your order implies the obligation to pay the price indicated. Only one method of payment is allowed per order.
The buyer who places the order is deemed to be solely responsible for booking and paying for it. Even if the order is placed on behalf of one or more third parties.
Payment can be made via our secure order pages using your debit card. Your card will be debited at the time you place your order and receive confirmation.
Credit card payments are not permitted.
ARTICLE 7 - ORDER CONFIRMATION
No order will be validated by the Organizer until it has been paid for and confirmed by the site. As soon as your order is paid, the site will display a confirmation message. An order confirmation email is then immediately sent to the purchaser; this confirmation email is necessary in order to participate in the Event; you will only be authorized to participate in the Event on presentation of the confirmation email. It is therefore your responsibility to check that you have received this confirmation. In the event of non-receipt after several hours, the participant is invited to contact the Organizer. However, non-receipt of the order does not entail its cancellation.
The Organizer reserves the right to cancel bookings which may reasonably be suspected to have been made fraudulently or in contravention of these terms and conditions.
ARTICLE 8 - TICKET ISSUE AND CONDITIONS OF USE
Confirmation
Confirmation of the reservation of tickets for the Event is sent to the purchaser's email address after each validated order.
Features
Each reservation includes the following information in visible or coded form:
- Identification of the Organizer;
- Name of Event;
- Last and first name of participant(s);
- Price paid by buyer;
- Unique order identification number.
Uniqueness
The ticket is only valid for the place, date and time to which it belongs. The ticket must be kept until the end of the Event.
Tickets are personal and non-transferable.
Reproduction, duplication or counterfeiting of tickets is prohibited. The Organizer reserves the right to refuse access to the Event site without refund.
Control
The Organizer is free to check the validity of tickets when accessing the Event.
Receipt
The Organizer is also required to check the identity of participants. Participants must therefore be able to prove their identity with a valid identity card or passport.
The Organizer may request further proof of identity when granting access to the Event.
ARTICLE 9 - CANCELLATION AND REFUND
The Organizer reserves the right to modify the start time of an Event without prior notice, in which case the buyer may choose to play or cancel their participation and be reimbursed.
The Organizer reserves the right to cancel an Event, even at the last minute, without prior notice. In this case, the buyer will be notified by email and may request a refund of the order.
A ticket may be reimbursed provided the participant cancels his or her participation before midnight on the day preceding the event via the Organizer's contact form available in the "About us" section of the https://www.circus-poker.com website. Refunds will be made by bank transfer to the bank account used to purchase tickets within 30 days. A deduction of 5% of the amount paid will be deducted from the amount refunded.
ARTICLE 10 - LIABILITY
Except in the case of gross negligence or wilful misconduct on its part, the Organizer shall not be liable for any direct or indirect damage, including but not limited to loss of profits, image, anticipated savings, clientele or data, caused to the user or a third party by the site, including but not limited to damage due to i) inaccessibility of the site, for whatever reason, ii) unauthorized access to the site by a third party and the consequences thereof, iii) the occurrence of a case of force majeure, iv) the content, in particular in the event that the site contains any data, file, component or more generally any element whatsoever, such as a virus, despite the protective measures provided for this purpose.
ARTICLE 11 - CUSTOMER SERVICE
For any request from the buyer concerning the Event or the receipt of their order, the buyer must first contact the Organizer via the contact form available in the "About us" section of the https://www.circus-poker.com website.
ARTICLE 12 - PERSONAL DATA
The purchase of tickets for an Event involves the processing of your personal data by the Organizer. This is described in greater detail in the privacy policy available here and in the cookies policy, which form an integral part of these conditions.
In accordance with the European Regulation (EU) 2016/679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data, you have a permanent right to access and rectify all data concerning you, simply make a request by email(privacy@circus.be).
The information required by the ticket office to process the order is: surname, first name and email address of the purchaser, as well as the surname, first name and identity card or passport number of participants in the Event.
Other information may be collected and processed, particularly in the event of postponement or cancellation of the Event, in accordance with the privacy policy.
ARTICLE 13 - APPLICABLE LAW
The applicable law is Belgian law. Any difficulty relating to the interpretation, formation and performance of the contract shall fall within the jurisdiction of the Tribunal de l'Entreprise de Liège, division de Liège, irrespective of the domicile of the defendant, without prejudice to article VI.83.23°) of the Code de droit économique.
