The present Terms of Sale apply to the online sale on the website https://www.circus-poker.com of tickets relating to participation in poker tournaments organized by the limited company (société anonyme) Gambling Management SA, with its registered office at Rue des Guillemins 129, 4000 Liège, Belgium, and registered under the number 0859.984.677 (hereinafter the “Organizer” or “Organizers”), at its business premises located at Av. Baron de Moreau 1, 5000 Namur, Belgium (hereinafter the “Event”).
These Terms of Sale apply to the sale of tickets by the Organizer.
The Organizer is involved in managing online ticket bookings for participation in the Event and is the organizer of the Event.
ARTICLE 2 – OBJECT
Gambling Management SA sells tickets exclusively in its own name and on its own account relating to the Event for which you purchase a ticket. This ticket remains the property of the Organizer and may be cancelled at any time upon refund of the stated purchase price.
Participation in the Event is only permitted for private purposes; participation within the context of professional activity is prohibited unless the Organizer agrees otherwise in advance. Any use of tickets in connection with any advertising or promotional activity is also strictly prohibited, including in connection with an offer of competitions or draws, unless express written permission is given by the Organizer.
ARTICLE 3 – PURCHASE AND CONDITIONS OF PARTICIPATION
The purchase of tickets is exclusively reserved for individuals over 21 years of age who are capable of sound judgment and possess a valid debit card.
All purchases are subject to debit card verification and other security checks, meaning that the transaction may be canceled if the verification process fails.
All credit or debit card transactions are charged at the time of purchase. If a purchase is made with a credit card, the amount will be charged immediately at the time of the transaction.
At the time of purchase, the purchaser must provide information about the people who will participate in the Event. Tickets bear the names of the participants and each participant must be in possession of their ticket.
In order to be permitted to participate in the Event, all participants guarantee the following:
- they are at least 21 years of age on the day of the Event
- they are in possession of a valid identity document
- they are not prohibited from gambling by the Belgian Gaming Commission or by the Organizer or due to their profession
- they will comply with the Organizer’s house rules
- they will comply with the rules applicable to the Event
The Organizer will verify the registration requirements when registering participants on the premises. The Organizer reserves the right to refuse registration of participants who do not meet the entry requirements for the premises or who do not meet the conditions for participation in the Event. In this case, the purchaser’s order will be refunded.
ARTICLE 4 – PRICE
The price of tickets includes an indication of currency according to the applicable rules. Unless otherwise indicated, prices are to be understood in euros and inclusive of all taxes. It is to be noted that in the event an erroneous price is displayed, whatever the reason (computer bug, human error, technical error, etc.), the order will be canceled even if already confirmed. We will inform you of this as quickly as possible. You will then be able, if you wish and subject to availability, to place your order again at the corrected price.
ARTICLE 5 – AVAILABILITY
The quality of the content placed online on the website is very important to the Organizer. The Organizer endeavors to the best of its ability to provide accurate and up-to-date information and to correct any errors that may be present as quickly as possible, as soon as these errors have been brought to its attention.
The Organizer does not guarantee that the website will remain accessible and free of any inaccuracies at all times and in all circumstances. The Organizer can therefore not be held liable for any damage or inconvenience that the user may suffer as a result of incorrect, inaccurate or missing information or as a result of a lack of clarity in the information provided on the website or the information provided by third parties about its services, for example on a third-party website that refers to these services.

ARTICLE 7 – ORDER CONFIRMATION
Orders will not be confirmed by the Organizer until they have been paid and verified by the website. As soon as your order has been paid, the website will display a confirmation message. An order confirmation email is then immediately sent to the purchaser; this confirmation email is necessary in order to participate in the Event. You will only be permitted to participate in the Event upon presentation of the confirmation email. You are therefore responsible for ensuring you have received this confirmation. If confirmation has not been received after several hours, the participant is requested to contact the Organizer. Nevertheless, a lack of receipt of the order does not entail its cancelation.
The Organizer reserves the right to cancel bookings that can be reasonably suspected to have been placed in a manner that is fraudulent or contrary to the present Terms of Sale.
ARTICLE 8 – ISSUANCE AND CONDITIONS OF USE OF TICKETS
Confirmation
The booking confirmation for tickets to the Event is sent to the purchaser’s email after each verified order.
Features
Each booking will contain the following information in a clear or coded form:
- identification details of the Organizer
- name of the Event
- name and surname of the participant(s)
- price paid by the purchaser
- unique order identification number
Unique nature
The ticket is only valid for the place, date and time to which it belongs. The ticket must be kept until the end of the Event.
Tickets bear the names of the participants and remain personal and non-transferable.
Reproduction, duplication or counterfeiting of tickets is prohibited. The Organizer reserves the right to refuse entry to the Event location without any refund.
Checks
The Organizer is free to check the validity of tickets upon entry to the Event.
Proof of identity
The Organizer is also obliged to check the identity of participants. Participants must therefore be able to prove their identity using a valid identity card or passport.
The Organizer may request the presentation of other proof upon entry to the Event.
ARTICLE 9 – CANCELATION AND REFUND
The Organizer reserves the right to change the start time of an Event without advance notice, in which case the purchaser may choose to play or cancel their participation and be refunded.
The Organizer reserves the right to cancel an Event even at the last minute without advance notice. In this case, the purchaser will be notified by email and can request a refund of the order.
A ticket can be refunded provided that the participant cancels their participation before midnight on the day before the Event via the Organizer’s contact form, which is available in the “About us” section of the website https://www.circus-poker.com. The refund will be made within 30 days by bank transfer to the bank account that was indicated when purchasing the tickets. However, a 5% fee from the amount paid will be deducted from the amount refunded.
ARTICLE 10 – LIABILITY
Except in the case of gross or intentional negligence on its part, the Organizer is not liable for any direct or indirect damage, including losses of profit, anticipated savings, customers or data, or reputational losses, caused to the user or a third party by the website, including but not restricted to damage caused by i) the inaccessibility of the website for any reason whatsoever, ii) unauthorized access to the website by a third party and the consequences that this may have, iii) a case of force majeure, iv) certain content, in particular in the event that the website contains data, a file, a component or more generally any element of any nature whatsoever, such as a virus, despite the protective measures in place.

Any difficulty relating to the interpretation, conclusion and performance of the contract falls within the jurisdiction of the Liège Business Court (Tribunal de l’Entreprise de Liège), Liège Division, no matter the domicile of the defendant, without prejudice to Article VI.83(23) of the Belgian Code of Economic Law (Code de droit économique).
